1. General provisions

1.1. This Privacy Policy (hereinafter the “Policy”) has been developed by Prodservis Limited Liability Company (EDRPOU code 24934992), acting in its own name on the basis of the information in the Unified State Register of Legal Entities, Individual Entrepreneurs and Public Organisations (hereinafter the “Site Administration” or the “Controller”), in accordance with the current legislation of Ukraine, in particular the Law of Ukraine “On Personal Data Protection” No. 2297-VI of 1 June 2010 (hereinafter the “Law”), with regard to users of the website https://www.prodservis.com (hereinafter the “Site”).

1.2. The Policy establishes the procedure for obtaining, collecting, accumulating, storing, processing, using, protecting and disclosing the personal data (hereinafter the “Data”) of users of the Site (hereinafter the “Users”).

1.3. Data means any information that directly or indirectly relates to a particular User. This may include: first name, last name, email address, phone number, region of residence, IP address, data about the devices used by the User (computer, browser type, mobile device operating system), messages (information contained in the User’s correspondence with the Site Administration), other communication information that the User voluntarily provides through forms on the Site, a registration form and/or when completing their profile on the Site (if such a feature is introduced) or writing a message and/or review, as well as information obtained during oral communication between the User and the Site Administration.

1.4. Data processing means any action or set of actions with Data, including but not limited to: collection, registration, accumulation, storage, adaptation, modification, updating, use, dissemination (distribution, sale, transfer), depersonalisation, destruction, as well as access to Data, its systematisation, blocking and deletion.

1.5. The Controller of the Data is Prodservis LLC. The Controller’s location and contact details are published on the “Contacts” page of the Site. Data processors may be third parties to whom the Controller entrusts the processing of Data to the extent necessary to provide services to the User (in particular, hosting providers, delivery services, payment services and IT service providers).

1.6. Terms used in this Policy and not defined herein have the meaning given in the User Agreement, the Public Offer and the Law.

1.7. The User consents to the processing of their Data in accordance with this Policy by ticking the consent checkbox in any form on the Site (feedback form, request for a commercial proposal, registration form, order form, etc.) before submitting the Data. By giving such consent, the User allows Prodservis LLC, as well as third parties providing services to Prodservis LLC (in particular, processing payments, making deliveries and ensuring the operation of the Site), to process their Data to the extent and for the purposes defined by this Policy.

1.8. Users may provide Data themselves by filling in forms on the Site or by communicating it by phone, to the email and/or postal address of Prodservis LLC, or Data may come from other sources (in accordance with Section 2 of this Policy), for example: User reviews (ratings, comments, confirmation of information), information from third parties provided when submitting claims or complaints and/or in the course of dispute resolution, and/or information from publicly available sources on the Internet.

1.9. The User is not entitled to use the Site if they do not agree with the terms of this Policy.

1.10. The User acknowledges that if they fail to comply with security measures to protect their Data and authorisation data (login, password), third parties may gain unauthorised access to the User’s account and Data. Prodservis LLC shall not be liable for any losses caused by such access if it became possible through the fault of the User.

2. What Data may be collected

The Site Administration may collect the following Data:

2.1. Last name, first name, patronymic, details of the company’s authorised person (representative), company name, company details, contact phone numbers, email address, company address, delivery address and other communication data at the User’s discretion.

2.2. Information about the User’s account (if registration and a personal account are introduced on the Site), in particular phone number, email address, login and password, and other Data necessary to serve Users of the Site and communicate with them, in particular when the User contacts the support service.

2.3. Information that Users provide to the Site Administration when concluding sale and purchase and/or service agreements by accepting the Public Offer published on the Site and/or when concluding other agreements with Prodservis LLC.

2.4. Information necessary for placing, fulfilling and confirming orders, delivering goods, making payments, sending and receiving messages, and posting reviews and comments.

2.5. Data about the devices used by the User and technical data, in particular: IP address, date and time of visits to the Site, information about software and the web browser, the mobile device operating system and the operation of the User’s devices, unique device identifiers, as well as mobile data (if the User uses a mobile application, should one be introduced).

2.6. Data obtained as a result of surveys conducted by the Site Administration and/or third parties authorised by it in connection with improving User service.

2.7. Information obtained by the Site Administration as a result of marketing activities.

2.8. Information posted by Users following their service: reviews, comments, requests to the support service, complaints, claims, etc.

2.9. Prodservis LLC may also process Data using the following technologies:

• cookies – small pieces of data that are sent to the User’s computer when visiting a web page and/or viewing an advertising module on a web page and are stored on the User’s computer or mobile device;
• pixels (web beacons) – small invisible images or pieces of code placed on a web page that make it possible to track how often the User visits the web page, identify the User’s browser and provide services, for example, to save the contents of the shopping cart between visits.

2.10. These technologies are also used to fix errors in the operation of the Site initiated by the User; the information is processed “as is” and is not changed in the process of collecting Data. The User may restrict or disable the use of cookies in their browser settings; in this case, some features of the Site may not work properly.

3. Purpose of Data processing

3.1. The Site Administration uses and processes Data for the purpose of:

• performing the functions, powers and duties assigned to the Site Administration in accordance with the current legislation of Ukraine, as well as ensuring the implementation of civil, commercial and tax relations;
• identifying the User and communicating with them, in particular to process requests, prepare commercial proposals, and conclude and perform agreements;
• placing and fulfilling orders, delivering goods, processing payments and carrying out settlement transactions;
• preparing reports and maintaining accounting and management records;
• creating and implementing bonus and loyalty programmes (if introduced);
• sending mailings by post and email, in particular commercial proposals, notifications of promotions and other Prodservis LLC news;
• improving the quality of service, analysing User activity, performing keyword searches, managing traffic on the Site, and analysing and predicting Users’ preferences and interests;
• conducting analytical and marketing activities.

3.2. Prodservis LLC does not process Data relating to racial or ethnic origin, political, religious or philosophical beliefs, membership of political parties and trade unions, or data concerning health. Information that characterises the physiological features of Users and on the basis of which their identity can be established is not processed.

3.3. The periods of Data processing and storage are determined based on the purpose of processing, the terms of agreements concluded with Users and the requirements of the current legislation of Ukraine.

4. Conditions of access to Data

4.1. When a User orders goods/services on the Site, Data may be transferred to third parties involved in fulfilling the order (delivery services, payment services, etc.) only to the extent necessary to identify the User and fulfil their order.

4.2. To demonstrate the effectiveness of the Site, Prodservis LLC may publish anonymised statistics on the operation of the Site without disclosing Users’ Data or information constituting a trade secret.

4.3. Among other things, the Site uses YouTube API Services. The Data of Users who use YouTube API Services is processed, stored and transferred in accordance with the YouTube API Services Terms of Service available at: https://www.youtube.com/t/terms, and in accordance with the Google Privacy Policy available at: https://policies.google.com/privacy.

4.4. The Site contains links to other web resources to which this Policy does not apply.

4.5. Prodservis LLC processes Data on lawful and fair grounds. Data is not disclosed to third parties or disseminated without the User’s consent, except in cases provided for by law and only in the interests of national security, economic well-being and human rights, in particular upon justified requests of state authorities that are granted the right by law to receive such Data.

4.6. The Site Administration reserves the right, in accordance with the requirements of the current legislation of Ukraine, to exchange Data with state authorities in order to prevent fraud on the Site, settle disputes and clarify circumstances that may be or become the cause of a violation of the current legislation, as well as in the event of detecting unlawful actions of Users of the Site and/or receiving claims, complaints or appeals from third parties.

5. The User’s rights as a personal data subject

5.1. In accordance with Article 8 of the Law, the User has the right:

• to know the sources of collection and the location of their Data, the purpose of its processing, and the location of the Controller or processor of the Data;
• to receive information about the conditions of access to Data, in particular information about third parties to whom their Data is transferred;
• to access their Data;
• to receive, no later than thirty calendar days from the date of receipt of the request, except in cases provided for by law, a response as to whether their Data is being processed, as well as to receive the content of such Data;
• to submit a reasoned objection to the Controller against the processing of their Data;
• to submit a reasoned request to change or destroy their Data if it is processed unlawfully or is inaccurate;
• to protection of their Data against unlawful processing and accidental loss, destruction or damage due to intentional concealment, failure to provide or untimely provision, as well as to protection against the provision of information that is inaccurate or discredits the honour, dignity and business reputation of an individual;
• to lodge complaints about the processing of their Data with the Ukrainian Parliament Commissioner for Human Rights or with a court;
• to apply legal remedies in the event of a violation of personal data protection legislation;
• to make reservations regarding the restriction of the right to process their Data when giving consent;
• to withdraw consent to the processing of Data;
• to know the mechanism of automatic processing of Data;
• to protection against an automated decision that has legal consequences for them.

6. How to change/delete Data or withdraw consent

6.1. Users may at any time change or delete their Data, unsubscribe from mailings or withdraw their consent to the processing of Data by sending a message to the email address: dd@prodservis.com, or by using the other contacts listed on the “Contacts” page of the Site.

6.2. Once such a message is received, the processing of the User’s Data will be stopped and their Data deleted, except where further processing is required by the current legislation of Ukraine (in particular, for accounting and tax purposes).

6.3. Certain features of the Site that require information about the User may stop functioning from the moment the Data is changed/deleted.

6.4. The Site Administration processes and stores Data to achieve the purposes specified in this Policy for the period necessary for this, but no longer than 5 (five) years from the date of the User’s last interaction with the Site, unless a longer period is established by the legislation of Ukraine.

7. Data protection

7.1. When processing Data, the Site Administration takes all necessary technical, organisational and legal measures to protect Data against unlawful and/or unauthorised access, in particular modification, deletion, provision and dissemination, as well as against other unlawful actions.

7.2. The Site Administration continuously monitors the measures taken to ensure the security of Data.

8. Additional terms

8.1. The Site Administration reserves the right to change the terms of this Policy at any time. In this case, the updated version will be published on the “Privacy policy” page of the Site and shall take effect from the moment of its publication, unless otherwise provided by the new version.

8.2. If the User does not agree with the changes, they undertake to stop using the Site and may withdraw consent to the processing of Data in the manner set out in Section 6 of this Policy.

8.3. If any provision of this Policy, including any sentence, clause or part thereof, is found to be contrary to the current legislation of Ukraine or invalid, this shall not affect the other provisions, which shall remain valid and continue in full force and effect. An invalid or unenforceable provision shall be deemed amended (corrected) to the minimum extent necessary to ensure its validity and enforceability.
